Servicios Basados en el Hogar y la Comunidad (HCBS)
Home and community-based settings are places where individuals with disabilities live and spend their days, for example: licensed community care facilities and other residential settings, work activity programs, and day programs. The Home and Community-Based Services (HCBS) rules ensure that people with disabilities have full access to, and enjoy the benefits of, community living through long-term services and supports in the most integrated settings of their choosing. The new rules explain what these settings should be like.
If you are a service provider who provides services to multiple consumers in the same location, we have to make sure these services do not isolate individuals from the community. It means that you may need to make changes in how you operate in order to meet the new federal rules by modifying policies and program designs, where and how your service is delivered, and providing training to assure that your staff members understand the expectations of the rules.

2017-18: HCBS Final Rule Compliance Funding Process
Please see the information below on new round of funding available for HCBS Final Rule Compliance. Eligible community-based providers can submit concept proposals for funding to help them comply with the new federal rules.
By Friday, January 5, 2018 service providers need to submit the required information to Pam Arturi, HCBS Manager at email@example.com to be considered for initial approval.
Minimum Wage Adjustment Rate
Effective January 1, 2016, the minimum wage in California increased from $9.00/hour to $10.00/hour. Service Providers are eligible to apply for rate increases to adjust employees pay to comply with the new minimum wage.
Providers whose rates are established by DDS (Community Based Day Programs and Work Activity Programs must submit their request(s) on the DDS website – www.dds.ca.gov/MinWage. Please go to that page and complete the workbooks. These workbooks must be sent to DDS no later than March 31, 2016. A copy of the workbook(s) should be sent to the vendoring regional center.
Providers with the following rates:
Alternative Residential Model (ARM) rates/respite facilities – New rates can be found in the DDS Letter click aquí.
In-Home Respite Agencies – DDS will revise these rates and send copies of the new cost statement to the service provider and the vendoring regional center
In-Home Respite Worker (service code 864) – New rate effective January 1, 2016 is $13.10/hour
Voucher and Participant-Directed Respite (service code 420 and 465) – New rate effective January 1, 2016 is $13.10/hour
Non-Mobile Supplemental Staffing – New rate is $1.20 per client hour.
Providers with rates set through negotiation by regional centers
If your rate has been set by the Westside Regional Center, you must complete the attached workbook(s), click aquí, and return them to Westside Regional Center with back-up documentation of one business quarter to document the items that you provided in your workbook(s), such as, payroll register with wage rate, EDD DE9c, worker’s comp insurance employee classification code, etc. This documentation must be included with your submission of your workbook(s) or it cannot be processed. Your information must be received by March 31, 2016.
Remember, only report those employees who are making less than $10.00 per hour.

Sick Leave Rate Adjustment
Dear Westside Regional Center Vendors,
Recent legislation, Assembly Bill (AB) 1522, entitles employees who work on or after July 1, 2015, and who work 30 or more days within a year, to accrue sick leave at a rate of one hour for every 30 hours worked. If your agency is NO providing a minimum of 24 hours or three paid sick days annually, you may submit a request to DDS and WRC for a rate adjustment.
ONLY WRC VENDORS WHO DO NOT PROVIDE A MINIMUM OF 24 HOURS OR THREE DAYS OF SICK LEAVE FOR THEIR EMPLOYEES ARE ELIGIBLE TO COMPLETE THESE FORMS.

Negotiated/Median Rates will be sent directly to Westside Regional Center. If you provide multiple services that have employees who currently do not receive paid sick leave, you must submit this form for each service that you provide. [Vendor number and service code(s)]. Please look carefully at the links below to verify which process covers your service(s).

- For all other services, please download the form aquí, Employee Sick Leave Worksheet WRC. YOU MUST CLICK ON “ENABLE CONTENT” before you can enter your information. You must also provide copies of your PAYROLL REGISTERS AND WORKER’S COMP INVOICES WITH THIS FORM. Please return to WRC. The form can be sent directly to WRC by hitting the SUBMIT button. Please email copies of your payroll registers and worker’s comp invoice (include your vendor number) to: firstname.lastname@example.org.
Rate adjustments cannot be completed without copies of these documents.
